Internet shop http://www.polsport.waw.pl/en/ is the property of POLSPORT LTD Tourist and Sport Products Manufactory, with its registered office at Wyszyńskiego 13 street, 05-530 Góra Kalwaria, REGON (National Economy Register): 0155667, NIP (Tax Identification Number): 123-00-04-083, KRS (National Court Register) 0000182569, hereinafter referred as the Seller.

 Shopping regulations of POLSPORT LTD. Internet shop

 I. General information

1. POLSPORT LTD Tourist and Sport Products Manufactory Internet shop, located on www.polsport.waw.pl site enables shopping through the Internet.
2. All products sold through www.polsport.waw.pl are new and come from official and legal distribution channels and are fully covered with producers guarantee in Poland.
3. The prices of products placed in the F.A.T. i S. POLSPORT Internet shop are in polish zloty and include VAT tax (are gross prices).

II. Rules of placing orders

1. Orders are taken via orders form, placed on the Polsport.waw.pl web sites or by fax (phone / fax. +48 22 727-33-03).
2. Orders are taken for 24 hours, all the year round.
3. E-mail address given by the user, as well as the phone number, may be used to fulfillment of placed orders.
4. The main condition of purchase fulfillment is, that the Purchaser fills up correctly the order form, available on the www.polsport.waw.pl. sites.
5. Orders placed on incorrectly filled form shall not be fulfilled.
6. In case of situations, when fulfillment of the placed order is entirely or temporarily impossible, F.A.T. i S. POLSPORT reserves the right to put off the order fulfillment, and obligates to inform immediately the Purchaser when such situation takes place.
7. F.A.T. i S. POLSPORT company, owner of www.polsport.waw.pl reserves right to refuse fulfillment of an order, when its reliability raise concerns.
8. Changes of prices in www.polsport.waw.pl Internet shop are not related to orders placed and confirmed before introducing price changes, with the exception, when product was not available in the time when order was placed.
9. F.A.T. i S. POLSPORT company reserves possibility of errors in software that might cause showing on www.polsport.waw.pl site incorrect information. There may also appear differences between images showed on the web site and actual appearance of offered products. Deviations and errors shall not be the ground to raise a claim. In case of any doubts, please contact our staff before taking decisions.
10. The Seller reserves the right to withdraw some products from the sales offer. In case, the product is withdrawn after placing an order, the Seller shall inform the Buyer of such situation.
11. Purchased products are delivered to the address indicated in the form.
12. Prices given on the web site, according to Civil Code (art. 71 of Civil Code), do not constitute a trading offer. F.A.T. i S. POLSPORT company reserves also a right to change the prices and not to fulfill orders, if the price is a result of error or harms the interests of the company.
13. If the price change is related to products already order by the Client, the Client shall be informed of such change, and can cancel the order, by sending immediately an e-mail message on the address marketing@polsport.waw.pl, with “Cancellation” in subject or by making a phone call to F.A.T. i S. POLSPORT company on +48 22 727-33-03.
14. VAT invoice is issued to every order.
15. VAT invoice may be send with a separate priority letter.
16. The Client, by placing an order, expresses consent to issue a VAT invoice without a signature.
17. Placing an order is equivalent to acceptance of this regulation.
18. The Client of the shop may become only an adult person or organizational unit, having a legal capacity.

III. Terms of payment, dispatch and personal receipt

1. The Client has a right to choose the manner of delivery, according to order form. There is a possibility of other than standard manners of delivery – after previous individual determination by e-mail, fax or by phone.
2. Ordered products are delivered with a Courier to the address indicated in order form.
3. Products may be collected in the F.A.T. i S. POLSPORT seat, at Wyszyńskiego 13 street, 05-530 Góra Kalwaria, from 9 to 16.
4. Dispatch costs are covered by the Purchaser. In defined situations (when the order is of minimum 10 000 PLN net value), the charge for delivery of order products may be transferred to F.A.T. i S. POLSPORT.
5. In our shop payments may be settled by:
   - cash on courier delivery, where the sum cannot exceed 5000 PLN gross. In situations, when order exceeds sum of 5000 PLN gross, the difference should be transfer on the F.A.T. i S. POLSPORT bank account,
   - cash in the F.A.T. i S. POLSPORT office, on personal receipt,
   - bank transfer before the delivery, on the F.A.T. i S. POLSPORT bank account in Deutsche Bank PBC S.A., account number : 77191010482209031066460001
   - when cash delivery, additional charges are added,
   - delivery term of ordered products is from 2 to 40 days (dependant on the order difficulty) from the order confirmation date, and in case of bank transfer made before the delivery, from the day, when the bank transfer is noted on the FATiS POLSPORT account
6. In case of product shortage in the warehouse, the Purchaser shall be informed of such situation and of related to this fact order fulfillment prolongation.
7. In case of order fulfillment prolongation, the Client have right to cancel the order.
8. When ordering a product marked as “made to request”, FATiS POLSPORT may ask for entire or partly prepayment.
9. The Buyer should, upon receipt, verify condition of the parcel as to state or not to state possible damage when transporting. In case damage is stated, a protocol with specified reservations of the parcel condition shall be demanded.
10. The Seller is not liable for mechanical damage resulting from transporting. Complaints in this matter should be made directly upon receipt. Accepting the parcel by Buyer without any reservations is resulting in loss of claims of any defect or damage of the parcel.

IV. Guarantee, complaints and product’s return

1. Products offered in FATiS POLSPORT are covered with the producer guarantee and are delivered with appropriate guarantee cards, if such are provided by the importer/producer. In other cases complaints are handled on the basis of tax receipt or VAT invoice, delivered together with the product.
2. In case of stated defects, the Client should contact FATiS POLSPORT.
3. According to the Act from 2nd March 2000 on protection of certain consumers rights and on responsibility for damage caused by dangerous product, the Client may resign of product bought in our internet shop, without indicating a reason, within 10 form the date of parcel’s receipt. It is possible only, when the product was not used and damaged in any manner. Products must be returned in original, undamaged packaging.
4. In case when Consumer wants to use above mentioned right of return, the product should be sent back at one’s own expense to the address of F.A.T. I S. POLSPORT, at Wyszyńskiego 13 street, 05-530 Góra Kalwaria. The dispatching cost of returned product is covered by the Client.
5. Parcel should have enclosed written statement of draw back from the agreement and account number, where the shop should return the payment.
6. polsport.waw.pl shop within 7 days shall verify the product and if it fulfils above mentioned requirements, correcting invoice will be issued. Original and copy of correcting issue will be send to the Client by registered letter.
7. The Client should send back signed copy of correcting invoice. Polsport.waw.pl shop shall repay the Client within 5 days from receiving the signed copy.

V. Final provisions

1. F.A.T. I S. POLSPORT company, the owner of www.polsport.waw.pl Internet shop undertakes to keep personal data confidential. Data shall not be used in marketing purposes and others that could violate Consumer’s rights. Every Buyer has access to his/her data and right to data’s modification and removing from database.
2. Any disputes shall be settled by the court competent for the defendant registered office.
